欢迎使用瞬言（InstantSpeech）（以下简称”本应用”）。在使用本应用前，请仔细阅读本服务条款（以下简称”本条款”）。您下载、安装或使用本应用，即表示您已阅读并同意接受本条款的约束。

1. 服务说明

本应用是一款口头表达练习与教练工具，为您提供以下功能：

2. 账户与订阅

  1. 订阅服务：本应用的部分功能（如 AI 教练高频使用）通过 App Store 订阅提供，订阅价格与周期以 App Store 展示为准。
  2. 自动续订：订阅为自动续订制。除非在当前订阅周期结束前至少 24 小时关闭自动续订，否则订阅将自动续费。
  3. 管理订阅：您可随时在「设置 → Apple ID → 订阅」中查看、管理或取消订阅。
  4. 退款：退款由 Apple 处理，请通过 Apple 官方渠道申请（如 App Store 报告问题）。
  5. 免费层：未订阅用户可使用基础功能，具体限制（如录音时长、每日条数、AI 分析次数）以应用内展示为准。

3. 用户行为规范

您同意在使用本应用时：

  1. 不将本应用用于任何非法目的；
  2. 不录制或转写包含他人隐私、商业秘密、违法内容或侵犯第三方权益的音频；
  3. 不试图破解、逆向工程或以任何方式破坏本应用的安全机制；
  4. 不对本应用的服务器接口进行恶意请求、刷量或攻击。

4. 知识产权

  1. 本应用及其全部内容（包括但不限于软件、界面设计、文本、图表、图标）的知识产权归徐博宇所有；
  2. 您对自己录制的音频、转写文本及其分析结果拥有完全的所有权；
  3. 您授予我们为实现服务功能所必需的、有限的、非独占的使用权（如将转写文本发送至 AI 服务商进行分析），该授权不构成对我们的任何知识产权转让。

5. 免责声明

  1. AI 反馈仅供参考：AI 教练提供的分析、建议与改写内容由人工智能模型生成，仅供参考，不构成专业建议（包括但不限于演讲培训、心理咨询、法律、医疗等领域的建议）。请结合自身判断使用。
  2. ASR 准确性：语音识别可能存在错别字或断句误差，本应用不保证转写结果的完全准确。
  3. 本应用按”现状”提供服务，我们不对服务的持续性、及时性、安全性或准确性作任何明示或默示的保证。

6. 责任限制

在法律允许的最大范围内，徐博宇不对因使用或无法使用本应用而产生的任何间接、偶然、特殊或后果性损害承担责任，包括但不限于数据丢失、业务中断、声誉损害。

7. 条款变更

我们可能不时更新本条款。重大变更将在应用内显著位置通知您。您在变更生效后继续使用本应用，即视为接受更新后的条款。

8. 适用法律与争议解决

本条款受中华人民共和国法律管辖。因本条款引起的争议，双方应友好协商解决；协商不成的，任何一方可向开发者所在地有管辖权的人民法院提起诉讼。

Welcome to InstantSpeech (the “App”). Please read these Terms of Service (the “Terms”) carefully before using the App. By downloading, installing, or using the App, you acknowledge that you have read and agree to be bound by these Terms.

2.1 Service Description

The App is an oral expression practice and coaching tool that provides:

2.2 Account and Subscription

  1. Subscription: Certain features of the App (such as frequent use of the AI Coach) are provided through an App Store subscription. Pricing and billing period are as displayed in the App Store.
  2. Auto-renewal: Subscriptions renew automatically. Unless auto-renewal is turned off at least 24 hours before the end of the current period, your subscription will be renewed automatically.
  3. Managing your subscription: You may view, manage, or cancel your subscription at any time under “Settings → Apple ID → Subscriptions”.
  4. Refunds: Refunds are handled by Apple. Please apply through official Apple channels (e.g., Report a Problem in the App Store).
  5. Free tier: Non-subscribers can use the basic features; specific limits (recording duration, daily count, AI analysis quota) are as displayed within the App.

2.3 User Conduct

By using the App, you agree to:

  1. Not use the App for any unlawful purpose;
  2. Not record or transcribe audio containing others’ private information, trade secrets, illegal content, or content that infringes third-party rights;
  3. Not attempt to crack, reverse engineer, or otherwise compromise the security of the App;
  4. Not make malicious requests, spam, or attacks against the App’s server endpoints.

2.4 Intellectual Property

  1. The App and all its content (including but not limited to software, interface design, text, graphics, and icons) are the intellectual property of Xu Boyu;
  2. You retain full ownership of your own audio recordings, transcription text, and analysis results;
  3. You grant us a limited, non-exclusive license necessary to provide the service (e.g., sending transcription text to an AI provider for analysis). This grant does not constitute any transfer of our intellectual property rights.

2.5 Disclaimers

  1. AI feedback is for reference only: Analysis, suggestions, and rewrites provided by the AI Coach are generated by an artificial intelligence model and are for reference only. They do not constitute professional advice (including but not limited to public speaking coaching, psychological counseling, legal, or medical advice). Please exercise your own judgment.
  2. ASR accuracy: Speech recognition may contain homophone errors or segmentation inaccuracies. We do not guarantee that transcription results are completely accurate.
  3. The App is provided “as is”. We make no express or implied warranties regarding continuity, timeliness, security, or accuracy of the service.

2.6 Limitation of Liability

To the maximum extent permitted by law, Xu Boyu shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the App, including but not limited to data loss, business interruption, or reputational damage.

2.7 Changes to These Terms

We may update these Terms from time to time. Material changes will be notified prominently within the App. Your continued use of the App after the changes take effect constitutes acceptance of the updated Terms.

2.8 Governing Law and Dispute Resolution

These Terms are governed by the laws of the People’s Republic of China. Any dispute arising from these Terms shall be resolved through friendly negotiation; if negotiation fails, either party may file a lawsuit with the competent people’s court in the developer’s jurisdiction.
